The law that forbids suspension of imprisonment sentence for corruption committed by government officials and public employees was published today in the official newspaper El Peruano.
The regulation, approved by the Congressional Permanent Commission in February, stipulates the amendment of article 57 of the Criminal Code and is aimed at promoting an effective imprisonment sentence for corruption charges.
The suspension of prison sentence is unenforceable for any intentional crimes prescribed in articles 384 and 387, that is, for collusion and graft charges, respectively.
The judge will be able to suspend its execution only if certain requirements are met, such as the fact that the sentence involves a deprivation of liberty for a period not longer than 4 years.
The judge can also suspend the said sentence if the condemned is a repeat offender or habitual offender.
